Terms of service

ANTI-PEOPLE APPARELS

TERMS OF SERVICE

Effective Date: August 27, 2026

These Terms of Service ("Terms") govern your access to and use of AntiPeopleApparels.com and any purchase, service, digital content, product, feature, or other transaction offered by Anti-People Apparels, LLC, operating publicly as Anti-People Apparels ("Anti-People Apparels," "Anti-People," "we," "us," or "our").

By visiting our website, creating an account, submitting information, placing an order, purchasing a product, accessing digital content, or otherwise using our services, you agree to be bound by these Terms and any policies incorporated into them.

If you do not agree to these Terms, do not use the website or complete a purchase.

Nothing in these Terms is intended to eliminate, restrict, or waive any consumer right that cannot legally be waived.

1. ELIGIBILITY

You must be legally capable of entering into a binding agreement to make purchases through Anti-People Apparels.

If you have not reached the age of majority in your jurisdiction, you may use the website or make a purchase only with the involvement and permission of a parent or legal guardian where permitted by law.

You may not use our website, services, or products for unlawful or fraudulent purposes.

2. ELECTRONIC AGREEMENT

You agree that transactions with Anti-People Apparels may be conducted electronically.

Electronic records, order confirmations, notices, communications, and agreements may satisfy legal requirements that information be provided in writing where permitted by applicable law.

By submitting an order or otherwise affirmatively accepting these Terms, you acknowledge that you have been provided an opportunity to review these Terms and the policies referenced within them.

3. CHANGES TO THESE TERMS

We may update these Terms from time to time.

Changes will become effective when the revised Terms are posted unless a later effective date is stated.

Material changes will apply prospectively and will not retroactively remove rights or materially alter the agreed terms of a transaction already completed where prohibited by law.

The Terms in effect when an order is placed generally govern that transaction, subject to applicable law.

4. ONLINE STORE PLATFORM

Our online store may be hosted or supported by Shopify and other third-party technology providers.

These providers supply technology that allows us to display products, process transactions, communicate with customers, and operate portions of the website.

Use of certain third-party services may also be subject to the applicable provider's terms and privacy practices.

Anti-People Apparels remains responsible for its own obligations to customers as required by applicable law.

5. ACCOUNTS & CUSTOMER INFORMATION

If you create or use a customer account, you are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account to the extent permitted by law.

You agree to provide accurate and reasonably current information when making a purchase.

This includes, where applicable:

  • Name.
  • Billing information.
  • Shipping or delivery address.
  • Email address.
  • Telephone number.
  • Payment information.
  • Selected product.
  • Size.
  • Color or colorway.
  • Quantity.

You are responsible for reviewing this information before submitting an order.

Contact us as soon as possible if information associated with an order is incorrect.

We cannot guarantee that changes can be made after fulfillment has begun.

6. PRODUCTS & PRODUCT INFORMATION

We make reasonable efforts to describe and display our products accurately.

However, differences in screens, monitors, lighting, photography, manufacturing processes, fabric characteristics, dyes, printing, embroidery, construction, and handcrafted techniques may cause reasonable differences between a product image and the physical product.

Minor differences that do not materially change the product from what was represented are not necessarily defects.

Product measurements may also contain reasonable manufacturing tolerances.

Customers are responsible for reviewing available product descriptions, size information, materials, colorways, specifications, photographs, and other information before purchasing.

Nothing in this section permits us to materially misrepresent a product or eliminates rights concerning merchandise that is materially defective, incorrectly supplied, or materially different from its description.

7. HANDCRAFTED, CUSTOM & ONE-OF-ONE CLOTHING

Anti-People Apparels may offer clothing that is individually:

  • Handmade.
  • Reconstructed.
  • Altered.
  • Painted.
  • Embellished.
  • Sewn.
  • Dyed.
  • Distressed.
  • Finished.
  • Customized.
  • Made-to-order.
  • Custom-altered.
  • Otherwise individually created or modified.

For purposes of our policies, these garments may be classified as:

HANDCRAFTED

CUSTOM

ONE-OF-ONE

Reasonable irregularities, variations, placement differences, texture differences, distressing differences, stitching differences, coloring differences, or similar characteristics resulting from individual production may be inherent characteristics of the garment rather than defects.

Handcrafted, custom, and one-of-one clothing is generally FINAL SALE, as explained in our Refund & Return Policy.

Final-sale status does not eliminate remedies required by law for merchandise that is materially defective, incorrectly supplied, or materially misrepresented.

8. ORDER SUBMISSION & ACCEPTANCE

Submitting an order does not guarantee that the order can be fulfilled.

We reserve the right, where permitted by law, to decline or cancel an order before fulfillment for legitimate reasons including:

  • Insufficient inventory.
  • Duplicate orders.
  • Incorrect product availability.
  • Obvious pricing or technical errors.
  • Payment authorization failure.
  • Suspected payment fraud.
  • Suspected return fraud.
  • Suspected unauthorized commercial purchasing.
  • Shipping or delivery restrictions.
  • Incorrect or incomplete customer information.
  • Violation of these Terms.
  • Quantity limitations.
  • Security concerns.

If we cancel an order after payment has been collected, we will refund amounts that applicable law requires us to return.

An automatically generated order confirmation confirms that we received the order. It does not guarantee that inventory, payment verification, fraud review, or fulfillment has been completed.

9. LIMITED INVENTORY

Certain Anti-People Apparels products are produced or released in limited quantities.

Placing an item in a shopping cart does not necessarily reserve that item.

Inventory may remain available to other customers until checkout has been completed and the order is successfully accepted by our system.

Items may sell out without notice.

We may impose reasonable purchase limits to promote fair access to limited merchandise or prevent fraudulent or unauthorized bulk purchasing.

10. PRICING

Prices are displayed in the currency indicated on the website.

Prices may change without notice for future purchases.

A price change will not retroactively alter the agreed price of a completed purchase except to correct an error where applicable law permits us to do so.

If an obvious pricing, system, or listing error occurs, we may cancel an affected unfulfilled order and issue any refund required by law.

We will not intentionally advertise a price that we do not intend to honor as part of a deceptive pricing practice.

11. TAXES

Applicable sales, use, local, or other transaction taxes may be collected where required.

The amount shown at checkout may vary depending on the customer's location, applicable exemptions, and legal tax requirements.

12. PAYMENT AUTHORIZATION

By submitting payment information, you represent that you are authorized to use the payment method provided.

You authorize Anti-People Apparels and our payment-processing providers to charge the amount presented at checkout, including applicable taxes, shipping charges, local delivery charges, and other authorized charges.

Payment authorization does not guarantee order acceptance.

We may take reasonable steps to verify a transaction when fraud or unauthorized use is suspected.

Verification may include requesting additional information reasonably necessary to confirm the order.

If an order cannot be reasonably verified, we may cancel the transaction and issue any refund required by law.

13. FRAUD PREVENTION

Anti-People Apparels may maintain reasonable transaction and fulfillment records for:

  • Fraud prevention.
  • Payment disputes.
  • Inventory control.
  • Return verification.
  • Loss prevention.
  • Chargeback responses.
  • Customer-service investigations.
  • Legal compliance.

Records may include order information, SKU, size, colorway, product characteristics, tags, photographs where appropriate, package contents, package weight, tracking data, delivery confirmation, communications, and return-inspection information.

We may compare returned merchandise with these records when investigating a return or payment dispute.

Fraudulent transactions, product substitution, counterfeit returns, intentional misrepresentation, theft, fabricated claims, or knowingly false claims may result in:

  • Order cancellation.
  • Refund denial where legally permitted.
  • Account restrictions.
  • Future-order restrictions.
  • Submission of relevant evidence to Shopify.
  • Submission of evidence to payment processors or financial institutions.
  • Submission of evidence to shipping carriers.
  • Referral to appropriate authorities where warranted.

Nothing in these Terms prevents a customer from exercising a legitimate legal right to dispute a transaction.

14. DISCOUNTS, PROMOTIONS & REWARD CODES

Discounts, promotional offers, subscriber benefits, reward codes, and similar offers are subject to their stated conditions.

Unless otherwise stated:

  • Discounts have no cash value.
  • Discounts cannot be applied retroactively to previous purchases.
  • Eligibility requirements must be satisfied at checkout.
  • Discounts may be limited to certain products, customers, dates, or order values.
  • Expired discounts will not be honored.
  • Discounts may not be reproduced, sold, altered, transferred, or fraudulently obtained where prohibited by the applicable promotion.
  • Discounts may combine only when our checkout system and the applicable promotion specifically permit combination.

Anti-People Apparels may cancel or refuse fraudulent or unauthorized use of a promotional offer.

A legitimately earned reward will be honored according to the conditions disclosed with that reward, subject to availability and applicable law.

15. ORDER PROCESSING

Standard orders are ordinarily processed within 1-3 business days after order confirmation and successful payment authorization.

Processing time is separate from carrier transportation or delivery time.

Processing may take longer when reasonably necessary because of:

  • High order volume.
  • Limited releases.
  • Fraud or payment verification.
  • Weekends or holidays.
  • Product availability.
  • Handcrafted or custom production.
  • Severe weather.
  • Emergency conditions.
  • Other circumstances reasonably affecting fulfillment.

Where a product has a specific processing, preorder, made-to-order, or production timeframe, the applicable product disclosure controls.

Business days generally exclude Saturdays, Sundays, federal holidays, and days when normal fulfillment operations are unavailable because of emergencies or closures.

16. SHIPPING AREA

Anti-People Apparels currently ships merchandise within the United States only, except where a specific checkout option expressly states otherwise.

We do not currently guarantee international shipping.

Anti-People Apparels may expand, reduce, or otherwise modify available shipping destinations for future orders.

If our checkout system accepts an order to a destination that we later determine cannot lawfully or reasonably be serviced, we may cancel the affected order and provide the refund required by applicable law.

17. SHIPPING

Shipping availability, rates, estimated timeframes, and carrier options may vary by order and destination.

Shipping rates and available services are displayed or calculated during checkout.

Any shipping timeframe represented by Anti-People Apparels is based on information reasonably available to us when the representation is made.

Carrier transit time generally begins after the carrier has physically received the package.

A shipping label being created does not necessarily mean that the carrier has already taken possession of the shipment.

Carrier delivery estimates are generally estimates and are not guarantees by Anti-People Apparels unless expressly stated otherwise.

If we cannot ship merchandise within a timeframe that applicable law requires us to honor, we will provide any required delay notice, cancellation option, consent request, or refund.

18. SHIPPING ADDRESSES

Customers are responsible for providing a complete, accurate, and deliverable shipping address.

This may include:

  • Recipient name.
  • Street address.
  • Apartment or unit number.
  • City.
  • State.
  • ZIP code.
  • Telephone number when necessary for delivery.

If a customer provides an incorrect or incomplete address, additional expenses resulting from correction, interception, return-to-sender service, or reshipment may be the customer's responsibility where permitted by law.

Anti-People Apparels will not charge the customer additional shipping expenses when an address problem resulted solely from our own fulfillment error.

Address changes requested after an order has been submitted are not guaranteed.

19. PO BOXES, APO & FPO ADDRESSES

PO Box, APO, and FPO addresses may be accepted only when a compatible shipping service is available through checkout or can reasonably service the destination.

Certain carriers, shipping methods, products, or package sizes may not support these addresses.

If a customer selects or provides an address that cannot be serviced by the selected shipping method, Anti-People Apparels may contact the customer for an alternative address or cancel the affected order when necessary.

Any cancellation or refund will be handled according to applicable law.

20. SIGNATURE CONFIRMATION

Anti-People Apparels does not require signature confirmation on every shipment.

However, we reserve the right, where reasonable and permitted by law, to require signature confirmation or enhanced delivery verification for certain orders, including:

  • High-value orders.
  • Limited or difficult-to-replace merchandise.
  • Replacement shipments.
  • Orders associated with heightened fraud risk.
  • Orders associated with previous delivery disputes.
  • Other situations in which additional delivery verification is reasonably appropriate.

When signature confirmation is required, someone authorized to receive the shipment must be available according to the carrier's delivery procedures.

21. SHIPPING DELAYS

Carrier delays, severe weather, natural disasters, transportation interruptions, government action, labor disruptions, emergencies, and similar circumstances may affect delivery after shipment.

We will make reasonable efforts to assist with legitimate delivery problems.

Nothing in these Terms allows Anti-People Apparels to disregard legally required shipment-delay notifications, cancellation rights, or refunds.

22. LOST, STOLEN OR MISSING PACKAGES

Customers should contact Anti-People Apparels promptly if an order appears lost, tracking indicates delivery but the package cannot be located, or another legitimate delivery problem occurs.

Claims may be reviewed using available evidence including:

  • Carrier tracking.
  • Delivery confirmation.
  • Address information.
  • Delivery photographs.
  • Carrier investigations.
  • Customer communications.
  • Package information.
  • Fulfillment records.

A carrier's delivered status may be considered evidence when investigating a claim but does not automatically eliminate rights provided by applicable law.

Anti-People Apparels does not guarantee an automatic refund solely because a customer reports that a package cannot be located after confirmed delivery.

Each legitimate claim may be reviewed individually according to the circumstances and applicable law.

23. LOCAL DELIVERY

Where local delivery is available, eligibility may depend on:

  • Delivery radius.
  • Order value.
  • Delivery address.
  • Product availability.
  • Delivery capacity.
  • Other conditions displayed during checkout.

The first local-delivery attempt will ordinarily be made within 24-48 hours after order confirmation.

Someone capable of verifying the applicable order number must be present to receive the order.

LOCAL-DELIVERY PACKAGES WILL NOT BE INTENTIONALLY LEFT UNATTENDED.

The person receiving the order does not necessarily have to be the purchaser, but they must be able to reasonably verify the applicable order information.

After two documented recipient-caused failed delivery attempts, Anti-People Apparels may cancel the local-delivery order.

Where permitted by law:

  • The amount paid for undelivered merchandise will be refunded.
  • Applicable refundable taxes will be refunded.
  • The local delivery fee may be retained for delivery services or attempts already performed.

If the failure to complete delivery is attributable to Anti-People Apparels rather than the recipient or customer, charges will be refunded as required by applicable law.

24. RETURNS & REFUNDS

All returns and refunds are governed by our separate Refund & Return Policy, which is incorporated into these Terms.

Customers are responsible for reviewing that policy before purchasing.

Our Refund & Return Policy includes, among other conditions:

  • A limited return-request period for eligible standard merchandise.
  • Prior return authorization.
  • Strict return-condition requirements.
  • Original tags remaining attached for qualifying size or color-selection returns.
  • Merchandise not being worn beyond reasonably trying it on.
  • Products sold as sets being returned as complete sets.
  • Unauthorized returns potentially being rejected.
  • Visibly worn, damaged, altered, substituted, incomplete, fraudulent, or otherwise noncompliant returns potentially being rejected.
  • Customer responsibility for return shipping in qualifying customer-choice returns.
  • Handcrafted, custom, and one-of-one clothing generally being final sale.
  • A strict no-exchange policy.

If these Terms conflict with a specific provision of the Refund & Return Policy concerning a return, the more specific Refund & Return Policy provision will generally control, subject to applicable law.

25. RETURN AUTHORIZATION & RETURN ADDRESS

Customers must receive return authorization before sending merchandise back to Anti-People Apparels.

Return requests should be directed to:

antipeopleapparels@gmail.com

Customers should include their order number and information concerning the requested return.

The applicable return address will be supplied after the return is authorized.

The return location may be our current fulfillment location or another authorized return location.

Anti-People Apparels does not publicly display its fulfillment or return address except where disclosure is required by law.

Customers should not send merchandise to:

  • An address located through an internet search.
  • An address appearing on a business registration.
  • A previous fulfillment address.
  • An address from an old shipping label.
  • Any address not specifically provided for the approved return.

Sending merchandise to an unauthorized address does not automatically create a right to a refund.

26. NO EXCHANGES

Anti-People Apparels maintains a strict no-exchange policy.

Customers eligible for a return may submit the return according to our Refund & Return Policy and place a separate new order for a different available product, size, or color.

Inventory is not reserved while a return is being processed.

Correcting merchandise that Anti-People Apparels shipped incorrectly is not considered a voluntary exchange.

27. ORDER CANCELLATIONS

Customer requests to cancel orders are not guaranteed.

Once fulfillment has begun, merchandise has been packed for dispatch, a shipment has been transferred to a carrier, or local delivery has begun, cancellation may no longer be possible.

If applicable law provides the customer with a mandatory cancellation right, that right will be honored.

28. DIGITAL PRODUCTS

Anti-People Apparels may sell or provide digital content including:

  • Books.
  • Written Transmissions.
  • Music.
  • Signals.
  • Artwork.
  • Downloads.
  • Audio.
  • Other digital material.

Unless expressly stated otherwise, purchasing digital content provides the purchaser with a limited, personal, nonexclusive, nontransferable license to access or use that content for personal purposes.

Purchasing digital content does not transfer copyright or ownership.

Unless authorized in writing, customers may not:

  • Reproduce digital content for distribution.
  • Resell it.
  • Upload it for public distribution.
  • Share downloadable files publicly.
  • Sell copies.
  • Remove ownership notices.
  • Claim the material as their own.
  • Use the material commercially.
  • Circumvent access controls.

Digital products may be final sale once delivered, downloaded, accessed, or supplied, except where applicable law requires otherwise.

29. GIFT CARDS & STORE CREDIT

Gift cards, store credit, or similar instruments are governed by the terms disclosed when issued and applicable law.

They may not be converted to cash except where required by law.

Fraudulent, altered, stolen, or improperly obtained gift-card credentials may be rejected where legally permitted.

30. INTELLECTUAL PROPERTY

The website and its original content are owned by or licensed to Anti-People Apparels and are protected by applicable intellectual-property laws.

Protected material may include:

  • Anti-People branding.
  • Logos.
  • Garment artwork.
  • Graphics.
  • Illustrations.
  • Photographs.
  • Videos.
  • Product designs.
  • Website graphics.
  • Written content.
  • Transmissions.
  • Signals.
  • Music.
  • Audio.
  • Books.
  • Story material.
  • Characters.
  • Archive concepts.
  • Product photography.
  • Marketing materials.
  • Original copy.
  • Packaging designs.

Except where legally permitted, you may not reproduce, distribute, sell, commercially exploit, modify, publish, publicly display, or create unauthorized derivative works from protected Anti-People content without permission.

Purchasing a physical garment or digital product does not transfer ownership of the underlying intellectual property.

31. TRADEMARKS & BRAND IDENTIFIERS

Names, logos, symbols, slogans, product identifiers, and other source-identifying material used by Anti-People Apparels may constitute registered or unregistered trademarks, trade dress, or other protected intellectual property.

Nothing on the website grants permission to use those identifiers in a manner that falsely suggests affiliation, sponsorship, authorization, or endorsement.

32. CUSTOMER REVIEWS & HONEST OPINIONS

Anti-People Apparels does not prohibit customers from sharing honest opinions about our products, services, customer service, or business.

Customers will not be penalized merely for posting a truthful negative review or criticism.

We may, where legally permitted, moderate content submitted directly to our website that:

  • Contains confidential information.
  • Contains another person's private information.
  • Is unlawful.
  • Is threatening or harassing.
  • Is obscene or abusive.
  • Infringes intellectual-property rights.
  • Is unrelated to our products or services.
  • Contains malicious code or spam.
  • Is clearly false or misleading.

Disagreement with a customer's honest opinion alone is not grounds for restricting that review.

33. CUSTOMER PHOTOS, FIELD REPORTS & SUBMISSIONS

Customers may voluntarily provide photographs, messages, field reports, feedback, reviews, suggestions, or other materials.

Providing feedback to us does not automatically give Anti-People Apparels ownership of the customer's photographs or creative work.

We will not treat a private photograph sent through customer service or email as permission for public advertising solely because the photograph was submitted.

If we want to publicly use identifiable customer-created content for advertising or promotional purposes beyond what is reasonably necessary to operate the service where it was submitted, we may request permission where appropriate.

Nonconfidential suggestions or ideas submitted specifically as feedback may be considered and used to improve Anti-People Apparels without an obligation to compensate the person who submitted the suggestion, unless otherwise agreed in writing.

34. PROHIBITED USES

You may not use the website or services to:

  • Commit fraud.
  • Make purchases using unauthorized payment information.
  • Submit knowingly false claims.
  • Attempt product-return substitution.
  • Interfere with website security.
  • Introduce malware or harmful code.
  • Attempt unauthorized access to accounts or systems.
  • Scrape protected content in violation of applicable law.
  • Impersonate another person.
  • Collect personal information unlawfully.
  • Infringe intellectual-property rights.
  • Harass or threaten others.
  • Manipulate discounts or checkout functions fraudulently.
  • Use automated systems to interfere with fair access to limited releases.
  • Conduct activity prohibited by applicable law.

We may reasonably restrict access or cancel unfulfilled orders associated with prohibited activity.

35. THIRD-PARTY LINKS & SERVICES

The website may contain links to or integrations with third-party websites or services.

These may include:

  • Payment processors.
  • Shipping carriers.
  • Social-media platforms.
  • External retailers.
  • Technology providers.
  • Other service providers.

A link or integration does not necessarily mean Anti-People Apparels controls or endorses every aspect of the third-party service.

Your interaction with a third party may be governed by that party's own terms and policies.

To the extent permitted by law, Anti-People Apparels is not responsible for independent acts, content, security practices, or services of third parties outside our reasonable control.

36. PRIVACY

Collection, use, disclosure, retention, and handling of personal information are governed by our Privacy Policy and applicable law.

By using the website, you acknowledge that you have been provided access to our Privacy Policy.

Nothing in these Terms authorizes Anti-People Apparels to use personal information in a manner prohibited by applicable privacy law.

37. EMAIL & MARKETING COMMUNICATIONS

Transactional communications concerning orders, payments, security, shipping, returns, delivery, or customer service may be sent when reasonably necessary to complete or service a transaction.

Marketing communications will be handled according to applicable law and the customer's applicable consent or subscription choices.

Customers may unsubscribe from marketing emails through the unsubscribe method supplied in those communications.

Unsubscribing from marketing does not necessarily prevent transactional messages required to process or service an existing order.

38. WEBSITE ACCURACY & ERRORS

We attempt to keep website information accurate but cannot guarantee that every piece of information will always be error-free or current.

The website may occasionally contain:

  • Typographical errors.
  • Technical errors.
  • Incorrect inventory information.
  • Pricing errors.
  • Product-description errors.
  • Broken links.
  • Outdated information.

We may correct errors and update future website content.

If an error materially affects an existing order, the order will be handled consistently with applicable law.

39. WEBSITE AVAILABILITY

We do not guarantee uninterrupted access to the website.

The site may occasionally become unavailable because of:

  • Maintenance.
  • Technical problems.
  • Security issues.
  • Platform outages.
  • Internet failures.
  • Third-party service failures.
  • Circumstances outside our reasonable control.

We may modify or discontinue website features where permitted by law.

This does not eliminate obligations already owed concerning completed transactions.

40. SUSPENSION OR TERMINATION OF ACCESS

We may suspend or restrict website or customer-account access where reasonably necessary because of:

  • Fraud.
  • Security threats.
  • Illegal activity.
  • Repeated abuse of services.
  • Violation of these Terms.
  • Attempts to interfere with our systems.

Suspension of an account does not eliminate refund, delivery, payment, or other rights and obligations arising from an existing transaction.

41. DISCLAIMER OF WEBSITE WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND GENERAL ONLINE SERVICES ARE PROVIDED ON AN "AS AVAILABLE" BASIS.

WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM EVERY TECHNICAL PROBLEM.

THIS SECTION DOES NOT DISCLAIM WARRANTIES, PRODUCT OBLIGATIONS, OR CONSUMER RIGHTS THAT APPLICABLE LAW DOES NOT PERMIT US TO DISCLAIM.

NO LANGUAGE IN THESE TERMS IS INTENDED TO EXCLUDE RESPONSIBILITY FOR FRAUD, INTENTIONAL MISCONDUCT, OR OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

42. PRODUCT WARRANTIES

Unless Anti-People Apparels expressly provides a separate written warranty, no additional voluntary warranty is created merely by descriptive or promotional language that applicable law does not treat as a warranty.

Nothing in these Terms eliminates an express warranty actually created by Anti-People Apparels or a warranty or consumer remedy that applicable law does not permit us to exclude.

43. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANTI-PEOPLE APPARELS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL ECONOMIC DAMAGES ARISING FROM USE OF THE WEBSITE OR A TRANSACTION WHEN SUCH DAMAGES MAY LAWFULLY BE EXCLUDED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR A CLAIM DIRECTLY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO ANTI-PEOPLE APPARELS FOR THE PURCHASE GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law and are not intended to limit liability for:

  • Personal injury where such limitation is prohibited.
  • Fraud.
  • Intentional misconduct.
  • Gross negligence where it cannot legally be limited.
  • Statutory consumer remedies that cannot be waived.
  • Any other liability applicable law prohibits us from limiting.

44. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for third-party claims, losses, or reasonable costs directly resulting from:

  • Your unlawful use of the website.
  • Your intentional violation of another person's rights.
  • Your infringement of intellectual property.
  • Fraudulent activity performed through your account.

This provision does not require a consumer to indemnify Anti-People Apparels for our own unlawful conduct, negligence, product defects, or obligations applicable law places upon us.

45. FORCE MAJEURE

Anti-People Apparels will not be responsible for delays or failures caused solely by circumstances beyond our reasonable control to the extent permitted by law.

Such circumstances may include:

  • Severe weather.
  • Natural disasters.
  • Fires.
  • Transportation interruptions.
  • Carrier interruptions.
  • Labor disruptions.
  • Government actions.
  • Emergencies.
  • Infrastructure failures.
  • Widespread internet outages.
  • Similar events outside our reasonable control.

We will still provide legally required notices, cancellation opportunities, refunds, or other remedies when applicable law requires them despite such an event.

46. PAYMENT DISPUTES & CHARGEBACKS

Customers experiencing a legitimate transaction issue are encouraged to contact Anti-People Apparels so we have an opportunity to investigate and resolve the matter.

Contact:

antipeopleapparels@gmail.com

Nothing in these Terms prevents a customer from exercising a lawful chargeback or payment-dispute right.

When a payment dispute is filed, Anti-People Apparels may provide relevant evidence to the reviewing:

  • Payment processor.
  • Financial institution.
  • Card network.
  • Shopify.
  • Shipping carrier.
  • Other authorized party.

Evidence may include:

  • Order information.
  • Checkout records.
  • Policy disclosures.
  • Tracking information.
  • Delivery confirmation.
  • Customer communications.
  • Product information.
  • Return authorization.
  • Return inspection.
  • Photographs.
  • Fraud-prevention records.

A customer is not entitled to knowingly obtain duplicate reimbursement for the same loss through both a merchant refund and a payment dispute.

Knowingly false payment disputes, fabricated non-delivery claims, product substitution, or other fraudulent conduct may be challenged using available evidence and handled as permitted by law.

47. INFORMAL DISPUTE RESOLUTION

Before filing a lawsuit concerning a dispute that could reasonably be resolved directly, Anti-People Apparels and the customer agree to attempt good-faith informal resolution.

A customer may send a written description of the dispute, applicable order number, and requested resolution to:

antipeopleapparels@gmail.com

The parties should make reasonable efforts to resolve the issue for at least 30 days after notice is received.

This provision does not require either party to delay action when doing so would:

  • Cause a legal deadline to expire.
  • Prevent access to an available small-claims procedure.
  • Prevent legally available emergency or injunctive relief.
  • Otherwise violate applicable law.

48. GOVERNING LAW

To the extent legally permitted, these Terms and transactions with Anti-People Apparels are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

If a consumer's home jurisdiction provides mandatory consumer protections that cannot legally be waived through a choice of Florida law, those mandatory protections remain applicable.

49. VENUE & JURISDICTION

To the extent legally permitted, disputes subject to jurisdiction in Florida may be brought in an appropriate Florida state or federal court having lawful jurisdiction and proper venue over the dispute.

Nothing in this section requires a consumer to bring a claim in a location when applicable law gives that consumer a non-waivable right to proceed elsewhere.

Nothing in these Terms requires Anti-People Apparels to publicly disclose its private fulfillment or business mailing address unless such disclosure is required by applicable law.

50. NO WAIVER OF MANDATORY CONSUMER RIGHTS

Nothing in these Terms is intended to waive, limit, or eliminate:

  • Rights that cannot legally be waived.
  • Remedies for materially defective merchandise where required by law.
  • Remedies for merchandise that was never supplied.
  • Rights concerning materially misrepresented products.
  • Lawful payment-dispute rights.
  • Mandatory warranty protections.
  • Mandatory privacy rights.
  • Mandatory consumer-protection rights.
  • Any other right that applicable law requires us to preserve.

Where a provision of these Terms conflicts with mandatory law, mandatory law controls to the extent of the conflict.

51. SEVERABILITY

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed when necessary.

The remaining provisions will remain in effect unless applicable law requires otherwise.

52. NO WAIVER

Failure by Anti-People Apparels to enforce a provision of these Terms on one occasion does not automatically waive the right to enforce that provision later.

A waiver will be effective only to the extent actually made or required by law.

53. ASSIGNMENT

You may not transfer contractual rights or obligations arising from misuse of the website to another person merely to avoid these Terms.

Anti-People Apparels may transfer its contractual rights and obligations as part of a legitimate:

  • Merger.
  • Acquisition.
  • Restructuring.
  • Sale of the business.
  • Transfer of substantially all relevant business assets.

Any such transfer remains subject to applicable law and existing consumer rights.

54. ENTIRE AGREEMENT & RELATED POLICIES

These Terms, together with applicable product disclosures and policies incorporated by reference, form the agreement governing use of the website and purchases from Anti-People Apparels.

Related policies may include:

  • Refund & Return Policy.
  • Privacy Policy.
  • Shipping & Local Delivery Policy.
  • Product-specific final-sale disclosures.
  • Promotional or discount conditions.

If a product page contains a specific clearly disclosed term applicable only to that product, that specific term may control over a more general provision of these Terms.

Applicable law always controls where a contractual provision cannot legally override it.
